The rules for using Care Tales, including that it is education rather than medical advice and that organization chat is stored and read by that organization.

These terms are between Care Tales, Inc. and you. "Care Tales", "we" and "us" mean Care Tales, Inc. "You" means the person using the service.
If a clinic or hospital gave you Care Tales, these terms cover your own use of it. A separate written agreement between Care Tales and that organization covers what the organization may do, what it pays and how it handles patient data. Where the two disagree, the organization's agreement governs that organization.
By opening a module, using a chatbot, creating an account or using our apps, you accept these terms. If you do not accept them, do not use the service.
Care Tales makes interactive patient education. Healthcare organizations choose modules and share them with patients by QR code, by link, through a widget on their own website or through our iOS and Android apps. Modules are available in English, Spanish, French, Russian, Portuguese and Haitian Creole, each at three reading levels. Care Tales staff review a module before it is marked verified.
The service also includes chat. An organization's chatbot answers from material that organization approved. A separate chat inside a module answers questions about that module.
Everything in the service is general education. It is not medical advice, a diagnosis or a treatment plan. Using Care Tales does not create a relationship between you and a doctor, and it does not create one between you and Care Tales.
Ask your own clinician about your care. If you think you have an emergency, call 911 or your local emergency number. Do not wait because of something you read here.
Chat answers are generated by Google Gemini models. They can be wrong, incomplete or out of date. Check anything important with your care team.
Conversations with an organization's chatbot are stored word for word. Providers at that organization can read them, and so can Care Tales admin and team staff. Do not type anything you would not want that organization to see. Chat is not a way to reach a clinician, and nobody is watching it in real time.
Care Tales adds safety instructions that an organization cannot switch off. They include telling people to call 911 for red-flag symptoms and telling the model that it is not a doctor and must not diagnose.
English is the source version. Other languages and lower reading levels are produced with automated tools and review. They may contain mistakes. Where versions disagree, the English version is the one we stand behind.
Illustrations, animations, avatars, spoken audio and video exist to explain an idea. They are not diagnostic images and they do not depict your own case.
You do not need an account to open a module. If you create one, give accurate information, keep your password to yourself and tell us at support@caretales.com if someone else gets into it. You are responsible for what happens under your account.
Staff and provider accounts must use two-factor authentication. Sign-in sessions end after 12 hours, or after 14 days if you chose to stay signed in.
The service is meant for people aged 13 and over. Someone under 13 should use it only with a parent or guardian's consent, and that adult is responsible for the use. The product does not verify age today. If you believe a child's information is in our system, write to support@caretales.com and we will remove it.
Use it to learn, to support your own care or, if you work for a customer organization, to do your job there. Our acceptable use policy has the full list of what is not allowed. In short: do not break the law, do not try to break into anything, do not scrape the service, do not resell the content and do not upload harmful code or other people's private information.
We may suspend access that breaks these rules.

Each organization has a switch that turns its AI features off.
Care Tales and its licensors own the modules, the software and everything else in the service. You get a limited, revocable, non-transferable right to use the service for the purposes above. You may not copy it, resell it, reverse engineer it or build a competing product from it.
An organization keeps ownership of the material it supplies for its own knowledge base. It grants us the right to host that material, process it and send relevant extracts to our model provider so its chatbot can answer.
Survey answers, ratings, comments and chat messages stay yours. You give us the right to store them, to show them to your organization where this agreement says so and to use them to run and improve the service. We may publish aggregated figures that do not identify anyone. We do not use your text to train AI models.
If you send us feedback or an idea, we may use it without owing you anything.
Our privacy policy explains what we collect and who receives it, including the fact that chat text goes to Google. Care Tales is built for HIPAA compliance. We are not HIPAA certified and we hold no SOC 2 report. Whether we are a business associate of your organization depends on the written agreement with it.
There is no automatic deletion schedule for patient data today. To ask for deletion, write to support@caretales.com.
Patients pay nothing. An organization pays what its written order or agreement says. The product does not take card payments, so billing happens outside the service.
We work to keep the service running, but we do not promise that it will be available or free of errors. We may add features, change them or remove them. If we retire something an organization depends on, we will tell that organization.
You can stop at any time, and you can delete your account in the app. Deleting an account deletes the user record and what is stored under it, your organization membership, your uploaded files and your sign-in record.
We may suspend or end access if these terms are broken, if there is a risk to other people or if the law requires it. Where it is reasonable to do so, we will say why first.
The service is provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that any module fits your situation.
To the extent the law allows, Care Tales is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the service is limited to the greater of fifty United States dollars or the amount paid to us for the service in the 12 months before the claim.
Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
If you use the service on behalf of an organization, that organization will cover claims, damages and reasonable legal costs that arise from its use of the service, from the content it supplies or from its breach of these terms. This section does not apply to a patient using modules to learn about their own care.
These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Whether disputes go to binding arbitration, and whether a class action waiver applies, is left open in this draft and must be settled in legal review.
If part of these terms cannot be enforced, the rest still applies. If we do not enforce something, we have not waived it. You may not transfer these terms. We may transfer them to a buyer of the business. These terms and the documents they link to are the whole agreement on this subject.
We may update these terms. A new version will appear here with a new effective date. When a change matters, we will give notice on the site or by email before it takes effect. Using the service after that date means you accept the new version.
